LoveStream by BUSTLD, LLC Additional Terms and Conditions.

IMPORTANT: BUSTLD, LLC (“We”, “Our” or “Us”) IS WILLING TO LICENSE THE RIGHT FOR THE COUPLE TO USE THE VIRTUAL WEDDING SERVICES PROVIDED BY US (“VIRTUAL WEDDING SERVICES,” or “LOVESTREAM”) ONLY UPON THE CONDITION THAT THE COUPLE ACCEPTS ALL OF THE TERMS CONTAINED IN THIS AGREEMENT AND THE BUSTLD TERMS AND CONDITIONS REFERENCED HEREIN (“AGREEMENT”). PLEASE READ THE TERMS OF THIS AGREEMENT AND ANY PROVIDED SUPPLEMENTAL TERMS CAREFULLY. BY CLICKING ON THE “I ACCEPT” BUTTON WHERE INDICATED OR USING THE VIRTUAL WEDDING SERVICES, THE COUPLE AGREES TO THE TERMS OF THIS AGREEMENT AND PAYING ALL APPLICABLE FEES. IF THE COUPLE DOES NOT AGREE WITH ALL OF THE TERMS OF THIS AGREEMENT, SELECT THE “I DECLINE” BUTTON WHERE INDICATED AND THE COUPLE SHALL NOT USE THE VIRTUAL WEDDING SERVICES AND RETURN ANY MATERIALS TO US. THE COUPLE SHOULD MAINTAIN A COPY OF THIS LICENSE FOR THE COUPLE’S RECORDS. 

The LoveStream by Bustld Virtual Wedding Services (“LoveStream”) Additional Terms and Conditions are in addition to and incorporate by reference the Bustld Terms and Conditions, which are linked hereto. In the event of any conflict between these LoveStream Additional Terms and Conditions and the Bustld Terms and Conditions, these LoveStream Additional Terms and Conditions shall control.

1.    The Client’s Registration Obligations. The Client acknowledges and agrees that, as part of the registration:

  • To provide true, accurate, current and complete information about the Couple as prompted by LoveStream’s registration form(s) (the 'Registration Data').

  • To maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If LoveStream suspects that such information is untrue, inaccurate, not current or incomplete, LoveStream has the right to suspend or terminate the account.

  • That the Client is legally competent to form a binding contract with LoveStream.

  • That the Client is not barred from accessing the LoveStream Services under the laws of any jurisdiction to which the Couple are subject.

  • In the Client’s use of LoveStream, the Couple will comply with all applicable national, state, and local laws.

2.    LoveStream Live Stream Services:  

2.1    Introductory Production Call. The Client is required to complete a production call at least 15 days before the event date (or within 2 days of purchase for quicker turnaround weddings) to discuss timeline, camera angles and any missing information.

2.2    Tech Trial Run. Once the Client has registered, we will set up a tech trial run with the appointed day-of contact. It is a 20-minute virtual meeting that gives a chance to practice entering/exiting the studio, review best practices and test camera angles + internet connection (when on-site).

The Client and their Day-Of Contact are responsible for reviewing the tech guide with best practices. The Client is also responsible for having their on-site contact available for the tech check and being on-site at their venue. The Client understands not doing the foregoing actions will possibly affect the quality of their stream and releases LoveStream from any liability related to day-of issues for tech issues. Rental equipment from LoveStream (if rented) is not guaranteed to be available for your tech rehearsal before event day. The tech rehearsal can still be conducted fully and should be scheduled accordingly.

2.3    LoveStream Obligations. LoveStream shall provide the following services:

  • Access to a third-party virtual meeting supplier (such as Zoom), provided the Client acknowledges that we are not provider of such services, have no liability for its technical operation and the Client will be subject to all terms and conditions of such supplier.

  • Set up of Client’s personal event website including one round of edits (additional edits available as an add-on);

  • Answer tech related questions via email or chat on the LoveStream site. Answer time is up to 2 business days and is only available during LoveStream business hours (9a-5p ET).

  • Be available for production calls and tech checks during business hours (9a-5p ET). Calls outside office hours may be available for an additional charge (inquire for more information).

  • Be available 60 minutes before Client selected start time to answer questions via phone for Client day-of contact and live chat for Client’s virtual guests.

2.4    Before The Event Day. The Client’s obligations before the Event Day shall be to:

  • Complete a production call to understand expectations. Failure to schedule this call will impact LoveStream’s ability to deliver services on event day;

  • Confirm stream start and end time as well as time zone at least 30 days before the event (or at time of purchase if purchased less than 30 days before the event);

  • Send any desired videos for live stream in mp4 format (with music included, if desired) no less than one week before event day;

  • Provide contact detail for the Client’s selected day-of contact (cannot be Client or – for weddings – a member of the wedding party) who will have a phone available that is not a streaming device;

  • Run speed test at event site, provide results to LoveStream and heed LoveStream’s advice on minimum speeds to properly stream;

  • Sign day-of waiver with understanding of on-site responsibilities;

  • Test any rented equipment and alert LoveStream team at least 24 hours in advance of any issues so they have time to troubleshoot;

  • Perform a tech-check;

  • Provide their own equipment (such as iPhones, iPads or Android phones) to stream from unless rented from LoveStream;

  • Alert all on-site guests and vendors that a live stream will be occurring and they may be filmed.

    • Client understands that their image, and the images of their guests and vendors, may be edited, copied, exhibited, published or distributed and waives the right to inspect or approve the finished product wherein the likeness appears. Photographic, audio or video recordings, name, and biographical information may be used by Bustld, LLC for inclusion on the website and similar marketing documents which may include but is not limited to: presentations, online/internet videos, media, social media or news (press). There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed.

2.5    Event Day Obligations. The Client’s obligations on the Event Day shall be as follows:

  • Client’s day-of contact (must not be Client or – for weddings - member of the wedding party; must have their own phone to communicate with LoveStream that isn’t a streaming device) will set up all Client or LoveStream provided equipment (on-site setup available as an add-on for some packages);

  • Client’s day-of contact will run day-of tech check which occurs 30 minutes before the started stream time. If day-of contact is late to join, the stream may be affected and Client releases LoveStream of any liability related to the tech check;

  • Provide any music that the Client wants streamed (DJ, live music, Bluetooth speaker, etc.);

  • All devices will enter the remote production studio no later than 15 minutes before the Client selected stream start time or LoveStream cannot guarantee that device can enter the stream;

  • Anyone can go to the third-party wedding website & tune in to watch the livestream ceremony (password option);

  • Chat function of the third-party site allows guests to communicate;

  • Couple understands the need to start on-time for their selected time slot. If the stream starts more than 15 minutes after selected start time, additional fees will apply at $100 per 15 minutes.

  • For weddings: Ceremony-only streams include either 30 or 60 minutes of continuous stream time (pending which package was purchased) before incurring additional time fees. Ceremony + reception streams include up to 75 minutes of stream time with one break of up to 60 continuous minutes of downtime before incurring additional time fees. Additional time can be purchased before the wedding for $150 per 30 minutes. On wedding day, time extensions will be charged at a higher fee of $100 per 15 minutes.  

  • At the Client selected end time, the stream will automatically end.

    • LoveStream cannot guarantee that the stream can start earlier than the scheduled time day-of.

    • LoveStream cannot guarantee a longer stream time on event day.

    • Should an event run behind on the day-of, LoveStream can not guarantee additional stream time. If the Client wants to extend, the day-of contact must alert LoveStream no later than 20 minutes before their scheduled end time.

    • If LoveStream can accommodate the extension, the Client agrees to the additional fee of $400 per hour, charged in 15 minute increments. The fee will be charged to the card on file one business day following the wedding. Invoice must be paid in full before final product is released.

    • Livestream ends.

    • We print & mail the virtual guestbook (add-on) within 8 weeks after the wedding, or after purchase (whichever is greater)

LoveStream’s additional obligations on Event Day shall be as follows:

  • Provide music rights necessary to stream music for all packages

  • All packages: Provide a dedicated remote LoveStream producer (not on-site) for Client and/or day-of contact to communicate with up to 60 minutes before Client selected start time. Producer will also support guests via chat bot on Client’s event website up to 60 minutes before Client selected start time. Producer will switch between up to 3 cameras based on timeline & cues provided by Client at least one week before wedding day.

  • Elite: Provide rental equipment including 3 streaming devices, 3 tripods with necessary adapters and wireless microphone.

  • White Glove: Hire an on-site production assistant through a 3rd party to work with the LoveStream remote production team.

2.6    LaterStream. The LaterStream package will follow the LoveStream process except where outlined below:

  • Client and day-of contact will both be available for a 20-minute production call;

  • On event day, day-of contact will have access to a producer for feedback 30 minutes before the scheduled ceremony start time.

  • Client may record videos from up to three (3) cameras during the ceremony and from up to one (1) camera during cocktail hour and reception. They can also submit up to two (2) pieces of pre-recorded media (such as a toast or slideshow) no later than 3 business days after the wedding. LoveStream will compile the product into a polished final edit, switching between camera angles. Final video can include up to 90 minutes of recorded time, based on length of recordings submitted by Client.

  • Once we receive the equipment back, the turnaround time for the edited video is up to ten (10) business days.

  • If Client has selected to simulate their video live, the live date must be at least 2 weeks after the event date.

  • Any additional recorded videos captured on a non-LoveStream device must be uploaded within 24 hours after the initial upload or they will not be accommodated in the final cut.

2.7    Post-Event. LoveStream’s obligations end once the below are delivered to the Client. Client can expect delivery of below items within 3 business days of the conclusion of their event. 

  • Copy of LoveStream video as it aired (no editing); 

  • Guest chat transcript in PDF form (text only);

  • Virtual guestbook in PDF.

Should Client rent any equipment from LoveStream, the final product will not be delivered until the equipment is mailed back.

The LoveStream custom website will be live for 2 weeks after the event date. At that point, the site will be archived for up to 3 months. After 3 months, the site will be permanently deleted. If you need access, please email lovestreamsupport@bustld.com with your name, date and your request. Requests will be accommodated on a case-by-case basis.

LoveStream will keep the final video in their files for up to 3 months. After 3 months, client is responsible for downloading their own video and it may be deleted from LoveStream’s files.

2.8    Add-Ons. Clients who select to access any of the services that are marked as Add-Ons. Any such services provided by a third-party supplier or Vendor shall be subject to such terms as provided by that third party or Vendor and we shall have no liability related to the operation or use of such Add-On services or products. 

The hardbound guest book includes up to 30 pages with up to 50 guest entries. Additional entries available (add-on). The book will be delivered to the provided mailing address within 8 weeks of the conclusion of the Event Date, or if purchased after the event, 8 weeks after purchase. Such service is provided by a third-party supplier or Vendor and shall be subject to such terms as provided by that third party or Vendor and we shall have no liability related to the final product. 

The custom slideshow add-on includes up to 75 photos and up to 4 songs. Couple must submit photos at least 2 weeks prior to wedding. One round of edits included.

3.    The Booth by LoveStream:

3.1    LoveStream Obligations. LoveStream shall provide the following services:

  • Access to a third-party photo booth platform, provided the Client acknowledges that we are not provider of such services, have no liability for its technical operation and the Client will be subject to all terms and conditions of such supplier;

  • Set up of Client’s personal event gallery;

  • Creation of Client’s personal custom background and overlay (with one round of edits; additional edits available as an add-on service);

  • Answer tech related questions via email or live chat on the LoveStream site. Answer time is up to 2 business days and is only available during LoveStream business hours (9a-5p ET);

  • Exclusive use of the rental equipment for the rental term in exchange for the package fee.

3.2    Client Obligations. The Client’s obligations shall be to:

  • Confirm event date and estimated final guest count at time of purchase;

  • Provide WiFi at venue to enable real-time sharing of photos;

  • Unpack rented equipment and alert LoveStream team at least 24 hours in advance of any issues so they have time to troubleshoot;

  • Use the rented equipment in a careful manner and comply with all setup and breakdown instructions;

  • Take all necessary precautions to prevent damage to the rented equipment, including, without limitation, the effects of adverse weather;

  • Understand that anyone can go to the third-party gallery  if they choose not to password protect;

  • Provide good access to the setup area which includes a paved walkway and no stairs (unless discussed with LoveStream prior to event);

  • Confirm the setup areas is inside (unless prior approval), level, paved and within 10-feet of a 120 volt electric outfit;

  • Confirm there is sufficient lighting in the setup area;

3.3    Photo Booth Attendant. If Client chooses a package with a photo booth attendant, these additional terms shall apply.

LoveStream’s obligations include:

  • Hire an on-site attendant through a 3rd party provider to work with the LoveStream remote tech team.

Client’s obligations include:

  • Confirm start and end time as well as time zone at least 30 days before the event (or at time of purchase if purchased less than 30 days before the event);

  • Provide contact detail for the Client’s selected day-of contact who will be responsible for supplying attendant with equipment and receiving equipment post-event;

  • The photo booth will open at the Client-selected start time and close at the Client-selected end time. Additional time with the attendant, if it can be accommodated, can be added on at the end of the event for an additional fee of $100 per 15 minutes. It will be charged to the card on file within one business day of the conclusion of the event.

3.4    Printed Photos. The Booth by LoveStream packages include unlimited digital photos. If Client chooses a package with a printed images, these additional terms shall apply. 

LoveStream’s obligations include:

  • Provide rental of a printer;

  • Provide enough ink and paper for the estimated guest count for 3 hours of the event (or additional time – add-on)

Client’s obligations include:

  • Provide accurate estimated guest count;

  • Provide WiFi at venue to connect kiosk to printer.

3.5    Post-Event. LoveStream’s obligations end once the below are delivered to the Client. Client can expect delivery of below items within 3 business days of the conclusion of their event:

  • Downloadable gallery of all images

  • Downloadable stats of shares with associated contact details

  • Any stats related to additional data gathered (if applicable)

However, the final product will not be delivered until the rental equipment is mailed back.

The gallery will be hosted by LoveStream for up to 30 days post-event. At that point, it may be permanently deleted. Client is responsible for downloading their own files.

3.6 Intellectual Property Rights Release Clause. By providing logos, colors, trademarks, or any other branding materials for the design of the photo overlay, the client hereby acknowledges that they possess the full rights to utilize said materials. Our company disclaims any legal repercussions arising from the client's use of provided intellectual property in the custom photo design.

4.    Equipment Rental. If a Client rents any of the equipment made available by LoveStream, the following terms shall apply:

4.1    Ownership. The Equipment shall at all times remain the property of LoveStream by BUSTLD, and the Client shall have no right, title or interest in or to the Equipment (save the right to possession and use of the Equipment subject to these Conditions).

4.2    Rental Period and Loss.

  • The rentals will arrive by end of day before the event day. If the Client needs sooner, expedited shipping is available at an additional charge (inquire for pricing). Roundtrip 2-day shipping is included with all packages. This will be confirmed on the equipment waiver prior to shipping.

  • The rental period shall be until the end of the day on the Event Day at which time the Equipment shall be returned the following business day using the prepaid label or an extended rental fee will be charged daily.

  • We will hold your card on file with a $1 charge, and charge such card for the full replacement value of the Equipment if you do not return it to us or if such Equipment is damaged or lost.

  • The Client shall give LoveStream immediate notice in the event the Equipment is lost, stolen or damaged as a result of the Client’s possession or use of the Equipment or if there is a claim or, for any reason, a threat of seizure of the Equipment. Should the Client replace or keep the equipment (or any piece of the equipment), they will be charged current cost to replace the equipment plus 20 percent admin fee.

  • The risk of loss, theft, damage or destruction of the Equipment shall pass to the Client on delivery of the Equipment to the Client, or where applicable, the Client’s appointed agent. The Equipment shall remain at the sole risk of the Client during the Rental Period and any further term during which the Equipment is in the possession, custody or control of the Client (“Risk Period”) until such time as the Equipment is returned to LoveStream.

  • The Client represents and acknowledges that they have requisite knowledge and experience to operate the Equipment.

  • In the event that the Equipment experiences a breakdown due to any defect in materials or workmanship, LoveStream’s liability shall be limited to the cost of repair, including parts and labor, to return the Equipment to full working order. These Conditions set forth the full extent of LoveStream’s obligations and liabilities in respect of the Equipment and its hiring to the Couple. In particular, there are no conditions, warranties or other terms, express or implied, including as to quality, fitness for a particular purpose or any other kind whatsoever, that are binding on LoveStream except as specifically stated in these Conditions. Any condition, warranty or other term concerning the Equipment which might otherwise be implied into or incorporated within these Terms, whether by statute, common law or otherwise, is expressly excluded.

4.3    LoveStream Mic Rental.

Should Client provide their own microphone, LoveStream will enable couple to test the mic before event day but does not guarantee that the microphone will work inside the studio during the stream. The Client will be responsible for providing all necessary cords, batteries and chargers. The Client’s day of contact must be able to troubleshoot the mic without help from a LoveStream producer when asked.

4.4    LoveStream Obligations. LoveStream shall:

  • LoveStream will arrange for shipment of the Equipment to Client at the delivery address specified by Client on the rental waiver one (1) business day prior to the Event Date.

  • Selection of the carrier shall be made by LoveStream.

4.5    Client Obligations. The Client shall:

  • At its expense and at all times during the Rental Period, keep and maintain the Equipment in good and substantial repair, condition and appearance in order to keep it in as good an operating condition (fair wear and tear only accepted); 

  • Use all Equipment only for the purposes for which it was designed and operate in a careful, prudent manner and in accordance with the instructions for use; 

  • Comply with all laws, regulations, rules or ordinances of lawfully constituted authorities relating to the possession, use, storage and transport of the Equipment; 

  • Keep LoveStream fully informed of all material matters relating to the Equipment; 

  • The Client shall cause any Products returned under these Terms to be in at least as good a condition as when delivered to Customer, ordinary wear and tear excepted and to be determined by LoveStream in its sole discretion, complete with all parts, excluding paper photo booth accessories (“Props”), and in compliance with applicable law. Any repairs to the Equipment upon return to LoveStream necessary to restore the Equipment to a condition as good as when such Equipment was delivered, and any replacement parts required due to the original parts being unfit for use or incurring damage beyond repair, shall be at Client’s sole expense. Any repairs to any Equipment required on return because of damage to such Equipment while in Client’s possession, or due to packing error on Client’s behalf shall be at Customer’s sole expense.

  • The Client agrees to indemnify and hold Bustld and its directors, officers, employees and agents, harmless from and against all liability and expenses (including legal costs on a full indemnity basis) howsoever arising or incurred, in respect of: (a) loss of or damage to property of the Client whether owned, leased or hired, arising from, relating to or in connection with the performance or non-performance of the these Terms; or injury to, or death of any person employed or engaged by the Client arising from, relating to or in connection with the performance or non-performance of the these Terms.

5.    UNPREDICTABLE NATURE: LoveStream will perform the agreed upon services in a professional manner and endeavor to plan and execute a successful event for the Couple. However, the Couple understands and agrees that weddings are fast-moving and unpredictable, with unexpected circumstances that may arise during the course of the planning process and/or on the day of the Wedding. LoveStream will not offer refunds following the occurrence of such circumstances.

One such event is Internet connection. LoveStream will provide insight and help to determine the best internet connection both before wedding day and on wedding day. However, in the instance that internet connection makes a live stream not possible, the client agrees to LaterStream as a backup option.

6.    MODEL RELEASE: Unless otherwise agreed in writing, LoveStream reserves the right to use photos from your event for promotion, display, advertisement, Internet, social media, publications, etc. LoveStream also reserves the right to contact your photographer and use those photos from your event for the promotional purposes listed above. Upon request, Client agrees to provide necessary authorizations to other event vendors in furtherance of this release.

7.    CANCELLATIONS. All Bustld & LoveStream purchases are non-refundable. Date changes for LoveStream are accommodated, based on availability, with at least 10 days’ notice for an additional fee of $50. Additional fees apply for holiday dates. Inquire for more information on these fees.

8.    PROFESSIONAL CLAUSE: LoveStream reserves the right to cease working on the event and terminate this Agreement if the Client is not cooperating toward the same goal and begin to interrupt the planning process (i.e. bad attitudes; treating the LoveStream staff, consultants or vendors unprofessionally; etc.). In this case, any monies paid will be kept by LoveStream as liquidated damages for its time and efforts up to the date of termination.  The Couple agrees that in the event that LoveStream determines in their sole discretion that they have suffered any inappropriate behavior by the Client or Client’s guests during the planning process or on event day which rises to the level of harassment (physical or verbal) toward consultant or its employees, the following steps will be taken: first, a verbal warning; second, LoveStream shall immediately terminate its services. If such harassing conduct occurs on the day of the event, the Client expressly agrees to release and hold consultant harmless from any and all liability as a result of LoveStream’s termination of this Agreement, an incomplete stream or unfinished photo booth session, and all payments tendered shall be retained by the consultant.

9.    LIMITATION AND LIABILITY. Client and LoveStream agree that in the event of mechanical failure, or for any other reason LoveStream is unable to provide a functioning photo booth pursuant to this agreement, LoveStream’s maximum liability is the return of any payments received. LoveStream will not be liable under any contract, negligence, strict liability, or other theory for direct, indirect, incidental or consequential damages (including without limitation, damages for lost profits or increased expenses) with respect to any claim arising from or related in any way to this agreement, the subject matter of this agreement, the services provided under this agreement, or the property where these services are being performed. If LoveStream is only able to provide partial services for any reason, the charges to Client will be prorated subject usage.

10.    CONFIDENTIALITY: Bustld owns, possesses or controls certain trade secrets and other proprietary and confidential information acquired through the expenditure of time, effort and money, including, but not limited to, planning documents, instructional documents, timelines, schedules, checklists, schematics, and terms of this agreement including pricing (“confidential information”). The Couple agrees to protect Bustld’s proprietary interest in the confidential information and keep it strictly confidential.

  • The Couple shall notify consultant of any changes to vendors, schedules, locations or other wedding details in a timely manner. Consultant shall not be responsible for any issues resulting from Couple’s failure to notify consultant of any such changes.

11.    HOUSE RULES: LoveStream is limited by the guidelines of the venue site management. All rules set out by each venue and vendor will be followed and respected.
